The ex who refuses to leave! Kevin Costner is ready to make Christine Baumgartner’s life a “living hell” to move her out by the end of the month. It is a time that Costner considers generous given that per the terms of their prenup, Baumgartner should have vacated the premises months ago.

When Baumgartner filed for divorce from her now-estranged husband, Costner in May, she had 30 days, per the terms of the pre-nuptial agreement signed to move out of the home. And Baumgartner agreed to the term when she signed the document 18 years ago.

Instead, Costner has found himself stuck with Baumgartner in the Santa Barbara home he purchased in the 1980s before the two were a couple. And it appears that the Dances With Wolves star has hit his breaking point with Baumgartner refusing to leave the home. However, sources say that it is anger with Baumgartner for making the move to divorce Costner before he could serve papers that has led to his insistence that the handbag designer leaves the home as soon as possible.

“This isn’t about the house, it’s about making Christine’s life a living hell for actually going through with the divorce,” a source close to Baumgartner explained. “He wants to humiliate her” and is “out for revenge.” And according to the source, the best way to do that is to leave her without a home or means to find one in the community that their children, Cayden, 15, Hayes, 14, and Grace, 13 have called home since birth.

They went on to say, “Christine said she wouldn’t be surprised if Kevin had her escorted off the property by police. It was Christine who wanted to make this transition as peaceful as possible for the sake of the children.”

And this seems to be the crux of the argument as to why Baumgartner has refused to budge from the home.

Why Christine Baumgartner Refuses To Move Out Of Kevin Costner’s House

Baumgartner has refused to move out of the Carpentaria, California home claiming that she does not have the financial means to do so. And when Costner refused to give her more money to find a suitable home in the Padaro Lane community where the kids would have the smoothest transition from living with both parents to living with one at a time, Baumgartner dragged her heels when it came to finding a new home.

In addition to the $1.5 million that Costner deposited into Baumgartner’s account, he has also offered to give her $30,000 per month to put towards the rental on a home. Costner also stated he would give Baumgartner $10,000 for moving expenses and would give her access to all the staff she needed to move to a new home.

Baumgartner has not touched a cent of what Costner has given her, according to The Daily Mail, saying it would “rob her of her ability to contest the prenup’s validity.”

“Kevin wants me to rent [a] place without [a] financial plan in place. However, [I] have our three children to think about,” Baumgartner explained. “It is contrary to their best interests to commit to rental that [I] may not be able to afford, particularly as that would ultimately lead to multiple relocations.”

She continued, saying, “My goal has been and continues to be maintaining as much stability for our children as possible, which includes having the proper resources and plan in place so that [I] can establish [a] stable home for them, rather than making temporary and inconsistent housing arrangements.”

And this is why Baumgartner challenged the prenup, asking for $248,000 per month from Costner instead.

Instead of accepting the money that Costner has given her to date, Baumgartner came up with a number that would help with an easier transition for not only herself but her children. And the number that Baumgartner felt was appropriate to set up a “suitable separate household” was $248,000. A number that Costner and his team flat-out rejected.

“Christine can afford to move,” a reply from Costner’s legal team read. “She has at her disposal almost $1,500,000 in cash to find alternative housing. Multiple 4-bedroom, 4-bathroom lovely homes are presently available, located in close proximity to Kevin’s separate property residence … Kevin made multiple offers to assist her in relocating.”

The problem appears to be that Baumgartner wants to continue to live the “extraordinary lifestyle” she has grown accustomed to, given her over-the-top spending over the years. And it appears that in part, the judge hearing the former spouses’ case agrees.

On Wednesday, a judge ruled that Baumgartner was entitled to $129,000 per month in temporary child support. This will continue until November when she and Costner are scheduled to present their cases regarding support.

Part of the terms of the order, however, are that Baumgartner has to move by July 31.

Now that Baumgartner has much more money to her disposal, she should have no problem moving. Whether she does, however, will be seen in a few short weeks.
